EU platform work directive targets algorithmic management and employment status

The European Union is implementing a directive aimed at regulating platform work, which seeks to address the legal status and working conditions of individuals performing tasks via digital applications, such as ride-hailing and food delivery services.

Central to this regulation is the principle that an individual's employment status should be determined by the actual conditions of their work rather than the specific name of their contract. The directive addresses how digital platforms organize, monitor, and control labor through algorithms, which often perform traditional employer functions like task allocation and performance evaluation.

In Poland, the Ministry of Family, Labour and Social Policy has published a draft law to implement Directive (EU) 2024/2831 into national legislation. This move follows the directive's entry into force on December 1, 2024, providing member states a two-year window for full implementation.
