Eurocash avoids 76 million PLN fine after Supreme Court ruling

The Supreme Court of Poland has refused to hear a cassation appeal from the President of the Office of Competition and Consumer Protection (UOKiK), effectively ending a legal battle regarding a 76 million PLN fine imposed on Eurocash.

The fine, originally issued in November 2021, was related to allegations that Eurocash abused its dominant position toward agricultural and food suppliers between 2018 and 2020. UOKiK claimed the company collected unjustified fees for services such as promotional leaflets, product placement without sales guarantees, and market analyses.

Previous rulings by the Competition and Consumer Protection Court and the Court of Appeal in Warsaw had already overturned the penalty. The Supreme Court's decision to reject the appeal means the previous judgments stand, and Eurocash will not be required to pay the fine.
