European Banking Authority calls for expanded MiCA crypto lending rules
The European Banking Authority (EBA) has submitted recommendations to the European Commission regarding the review of the Markets in Crypto-Assets (MiCA) regulation. The EBA is urging regulators to expand the scope of MiCA to include crypto-asset lending, specifically targeting activities involving decentralized finance (DeFi) protocols.
Key proposals from the EBA include conducting a cost-benefit analysis for regulating crypto borrowing and lending, implementing suitability tests for users, setting leverage limits, and increasing disclosure requirements. The regulator noted that crypto lending is active in at least 16 EU member states and that the rise of AI and DeFi is blurring the lines between centralized and decentralized finance.
Additionally, the EBA has called for a review of minimum reserve requirements for issuers, particularly regarding the amount held in deposits. The authority also highlighted risks associated with multi-issuer stablecoin schemes from third countries and suggested that the regulatory framework should address potential regulatory arbitrage and consumer risks such as fraud, hacks, and excessive leverage.
