European Commission proposes Public Procurement Act to reform EU spending rules
The European Commission has proposed the Public Procurement Act, a major reform intended to replace three existing directives with a single, directly applicable regulation. This overhaul aims to modernize the EU's procurement framework, which accounts for approximately 15 percent of the Union's GDP, or roughly 2.6 trillion euros annually.
Key objectives of the reform include simplifying administrative procedures, which is estimated to save 649 million euros annually, and creating a single digital market to facilitate cross-border bidding. The proposal shifts the focus from the lowest price to the best quality-price ratio. Under the new rules, quality must represent at least 30 percent of the award criteria, increasing to 50 percent for labor-intensive contracts.
The reform also serves as a strategic tool to bolster European industry and economic resilience. It allows authorities to favor European companies and potentially exclude bids from third countries that do not respect international rules or provide reciprocal access to EU markets. This is viewed as a mechanism to counter competition from major powers like China. Additionally, the act introduces clearer legal bases for green procurement, emphasizing sustainability, circular economy, and energy efficiency.
