European General Court rejects NGO challenge to EU emission quotas

The General Court of the European Union has dismissed a legal challenge brought by two environmental organizations, the Global Legal Action Network (GLAN) and Climate Action Network Europe (CAN-Europe), regarding the EU's greenhouse gas emission allocations for member states between 2023 and 2030.

The NGOs argued that the European Commission's emission reduction targets were insufficient under European law, the Paris Agreement, and other international obligations. However, the Court ruled that the Commission was merely executing emission quotas previously established by the European Parliament and the Council.

The judges noted that the Commission lacks the authority to modify or replace these legislative climate objectives with more ambitious ones. The Court stated that allowing the Commission to revise these targets through internal reviews would undermine the institutional balance and the principle of legal certainty.
