European Union adopts stricter migrant return regulations
EU Interior Ministers have agreed on a new set of stricter regulations aimed at improving the enforcement of migrant return decisions. The agreement, reached in Luxembourg, shifts the focus of migration policy from administrative procedures to more effective implementation of removals.
A central feature of the new regulation is the ability to establish return hubs in third countries outside the European Union. This mechanism is intended to provide a legal framework for the removal of individuals who do not have a right to reside in the EU. Additionally, a new European return warrant will allow member states to mutually recognize deportation orders issued by other member states.
The regulations introduce sanctions for individuals who refuse to cooperate with authorities during the return process. These penalties may include reduced social benefits, fines, or criminal charges, depending on national laws. For individuals deemed security threats, states may implement permanent entry bans and detention periods of up to 24 months.
The policy change follows data showing a 55 percent decrease in irregular arrivals over the last two years, though actual return rates remain low. In 2025, while nearly 492,000 people were ordered to leave the EU, only 135,000 actually departed. The new rules will not apply to unaccompanied minors and are expected to be primarily applicable starting in September 2027.
