European Union approves stricter migrant return rules

The Council of the European Union has officially approved new, stricter rules aimed at streamlining the return of migrants who do not have a legal right to reside within the union. The reform, which complements the EU Pact on Migration and Asylum, seeks to address the issue where approximately two-thirds of individuals ordered to leave the EU fail to do so.

Key provisions of the new regulation include the ability for member states to establish return centers in third countries. These agreements can only be made with nations that respect international law and human rights principles. Such centers may serve as final destinations or interim facilities for repatriation to a country of origin. However, the rules prohibit the transfer of unaccompanied minors to these external centers.

Additionally, the rules introduce a European Return Order to facilitate information sharing and mutual recognition of return decisions among member states. Non-compliant third-country nationals may face sanctions, including the reduction of benefits or criminal penalties. The regulation will enter into force shortly after its publication in the Official Journal of the EU, with certain provisions applicable immediately and others following a one-year preparation period.
