EV charging rights for tenants evolving in Germany and Switzerland
Legal frameworks regarding electric vehicle (EV) charging infrastructure in rental properties are evolving in Germany and Switzerland.
In Germany, under § 554 of the BGB, tenants have a legal claim to have landlords approve the installation of charging equipment. While landlords cannot refuse consent without reason, they may impose specific conditions, such as requiring certified electricians or detailed installation plans. Generally, the tenant is responsible for all costs associated with the purchase and installation of the wallbox and necessary electrical work.
In Switzerland, the Federal Council is considering a motion to allow tenants and condominium owners to demand the creation of necessary charging infrastructure. This would require owners to provide power connections to parking spaces and systems for billing and load management. The proposal faces opposition from the Swiss Real Estate Association and the HEV Swiss Homeowners Association, who argue it would force owners into unwanted investments. Under current discussions, the user would remain responsible for the cost of the charging station itself.
