EWE Go appeals court ruling on electric vehicle roaming prices

The Munich Regional Court I ruled that EWE Go’s pricing policy for electric vehicle charging was unlawful, a decision the operator is now appealing to the Higher Regional Court of Munich.

The dispute involves Digital Charging Solutions (DCS), a service provider for brands including BMW, Mercedes-Benz, Porsche, and Hyundai. The legal conflict arose because EWE Go charged DCS a B2B roaming rate of approximately 84 cents per kWh, while customers using the EWE Go smartphone app paid only 52 cents per kWh for the same service.

The lower court determined that this significant price discrepancy violated Article 5, Paragraph 3 of the EU Alternative Fuels Infrastructure Regulation (AFIR), which mandates that prices for mobility service providers must be appropriate and non-discriminatory. While the court awarded damages to DCS, EWE Go maintains that its pricing remains fair and transparent and has filed an appeal to contest the ruling.
