Extremadura Court upholds denial of permanent disability for ONCE vendor

The High Court of Justice of Extremadura has upheld the denial of permanent disability for a vendor for the ONCE organization. The individual, born in 1981, sought permanent disability status after exhausting sick leave, citing conditions including juvenile glaucoma, bilateral amaurosis, and a mixed anxiety and depressive disorder.

Although the individual holds a recognized 92% disability degree from the Extremadura Disability Care Center, the court ruled that the medical evidence provided during the process did not sufficiently prove the severity of the alleged conditions or the necessity of third-party assistance for daily activities. Specifically, the court noted that a claim of severe major depressive disorder with psychotic risk was not included in the proven facts of the judicial resolution nor adequately accredited during the proceedings.

As the legal requirements for absolute permanent disability or total invalidity were not met based on the documented limitations, the court dismissed the appeal. The ruling is not final and may be appealed to the Supreme Court.
