FDA introduces new regulatory frameworks for AI medtech and rare disease drugs
The U.S. Food and Drug Administration (FDA) is implementing new regulatory approaches for both AI-enabled medical technology and rare disease therapies.
Regarding AI-enabled digital health, the agency is providing increased regulatory clarity through guidance on Clinical Decision Support Software and General Wellness products. While these policies may offer a more predictable path to market, they require investors to conduct rigorous due diligence regarding intellectual property ownership, patentability of AI-assisted inventions, and the legal rights to training data and algorithms.
Simultaneously, the FDA has announced the ‘Rare Disease Framework Initiative.’ This initiative aims to move away from a ‘one-size-fits-all’ approach by reviewing standards for individual conditions. The agency plans to reimagine the regulation of therapies for rare diseases, covering stages from pre-clinical trial engagement to post-marketing requirements. The FDA intends to solicit feedback on this plan during a meeting in late October, with initial recommendations potentially targeted for February.
