Federal Constitutional Court rules on uncle's inheritance rights
The Federal Constitutional Court has issued a significant ruling regarding inheritance rights, determining that the children of a deceased brother do not have a legal claim to their uncle's estate if Sharia heirs are present.
The court clarified that under Hanafi inheritance law, the children of a brother who predeceased the deceased do not receive a share through the principle of representation. The ruling emphasized that mere blood relation does not automatically establish an inheritance right; the legal status of the heir must be considered.
Furthermore, the court addressed the application of Section 4 of the Muslim Family Laws Ordinance 1961. It ruled that this specific legal provision is a departure from general inheritance law intended solely for the children of a deceased son or daughter. The court stated that this legal benefit cannot be extended to the children of a deceased brother through analogy or expansion of the law.
