James Comey faces third set of federal charges FAST-MOVING

The U.S. Department of Justice has filed a third criminal case against former FBI Director James Comey, accusing him of communicating and conspiring to disclose national defense information. The charges, filed in a Washington, D.C. federal court, stem from an incident in October 2016 involving the disclosure of sensitive information to a New York Times reporter regarding government email surveillance of Yahoo.

Prosecutors utilized a “criminal information” filing rather than a grand jury indictment, a move the DOJ states was intended to toll the ten-year statute of limitations while the investigation remains ongoing. Comey has denied all wrongdoing, characterizing the prosecution as an “appalling abuse” of the Department of Justice and a campaign of political retribution by the Trump administration.

Defense attorneys have requested a dismissal, arguing that the statute of limitations has already expired and that the matter was previously investigated by federal authorities without resulting in charges. This legal escalation follows two other recent cases against Comey involving alleged false statements to Congress and a social media post. The announcement coincided with a separate court ruling that Maurene Comey, the former FBI Director's daughter, was unlawfully terminated from her position as an assistant U.S. attorney.
