Federal judge blocks warrantless immigration arrests in Southern California

A federal judge in Los Angeles has issued a preliminary injunction blocking immigration agents in Southern California from conducting warrantless civil arrests without first performing a likelihood-of-escape analysis. U.S. District Judge Maame Ewusi-Mensah Frimpong ruled that federal agents have been regularly failing to conduct these required assessments, violating federal statutes.

The ruling applies to the Central District of California, covering Los Angeles and surrounding counties including Orange, Riverside, San Bernardino, Ventura, Santa Barbara, and San Luis Obispo. The court certified a class of individuals who have been arrested without warrants or escape risk assessments since June 6, 2025.

Under the court order, agents must consider the totality of circumstances before making an arrest and must document their specific findings regarding escape risk. Additionally, the judge ordered agents to stop using a January memorandum from former acting ICE director Todd Lyons, which suggested that being undocumented alone was sufficient evidence of a flight risk.
