Federal judges rule against unlawful immigration detentions

Two separate federal court rulings have addressed the legality of immigration detentions in the United States.

In Colorado, U.S. District Judge Philip Brimmer ordered the release of Ronald Alexander Castaneda Aguirre, an El Salvador native. Aguirre had been transferred into immigration custody following convictions for marijuana possession and driving under the influence. The court ruled that his continued detention violated Fifth Amendment due process protections, as federal authorities failed to demonstrate that he posed a flight risk or a danger to the community, nor did they argue that his convictions required mandatory detention.

In Pennsylvania, U.S. Magistrate Judge J. Maureen Kelly held three senior administration officials in civil contempt following the unauthorized arrest of Nain Vasquez Gonzalez. Despite a prior court order for his release due to unconstitutionally prolonged detention, immigration agents arrested Gonzalez during a nationwide enforcement surge. The judge ordered the officials to pay legal fees, criticizing the government for failing to produce body-camera footage and providing inconsistent explanations regarding the incident.
