Ferdinand Waititu and wife remain in custody as sentencing is delayed

Former Kiambu Governor Ferdinand Waititu and his wife, Susan Wangari, will remain in custody as the Anti-Corruption Court postponed their sentencing in a Sh588 million roads tender case. The delay follows a legal dispute regarding a High Court judgment issued on October 14, 2026, which overturned previous acquittals and affirmed money laundering convictions.

Chief Magistrate Harrison Barasa stated that the court must seek guidance from the High Court through the Deputy Registrar to clarify whether the defendants should be sentenced as individuals or in a corporate capacity. The defense argued that the defendants should not face sentencing for charges they were previously acquitted of at the trial level, while state prosecutors maintained that the High Court's ruling requires the court to proceed with mitigation and sentencing.

Waititu is currently held at Nairobi Remand Prison, while Wangari is held at Lang’ata Women’s Prison. The matter is scheduled to be mentioned again on October 27, 2026, once the High Court's directions are published.
