FGTS projected to distribute R$ 13 billion to Brazilian workers in 2026

The FGTS (Severance Indemnity Fund) is projected to distribute approximately R$ 13 billion in profits to 138.2 million workers in 2026. This distribution is based on the fund's financial performance during 2025. To qualify, workers must have had a positive balance in at least one FGTS account as of December 31, 2025, including both active and inactive accounts. The exact amount to be shared will be determined by the Board of Trustees.

Separately, the Superior Labor Court (TST) has established new jurisdictional rules regarding FGTS withdrawals. Legal actions related to the termination or suspension of employment contracts must now be judged by the Labor Court. However, cases involving reasons independent of the employment contract—such as serious illness, retirement, death, housing financing, or public calamities—will fall under the jurisdiction of common state or federal courts. This decision aims to resolve previous legal uncertainties between the TST and the Superior Court of Justice (STJ).
