Fifth Circuit voids Department of Energy stove efficiency rule
The 5th U.S. Circuit Court of Appeals has struck down a Department of Energy rule that established new efficiency standards for gas and electric stoves and ovens. In a unanimous 3-0 decision, the court ruled that the Biden administration improperly bypassed required public comment procedures by utilizing a direct final rule for the consumer-grade appliances.
The contested rule, issued in August 2024, sought to limit energy consumption in kitchen appliances and ban older linear power supply technology. The ruling follows challenges from seven Republican-led states: Louisiana, Mississippi, Montana, Nebraska, Tennessee, Texas, and Utah.
Nebraska Attorney General Mike Hilgers characterized the decision as a victory against federal overreach, noting that the administration had ignored formal objections from several states. Following the ruling, a Department of Energy spokesperson stated that the Trump administration remains committed to ensuring consumers can choose appliances that fit their specific budgets and needs.
