Financial and health portability rules in Brazil

In Brazil, consumers can utilize portability mechanisms to transfer health insurance plans and credit debts to different providers under specific regulatory conditions.

For health insurance, the National Health Agency (ANS) allows beneficiaries to switch plans without fulfilling new waiting periods, provided they meet certain criteria. Requirements include being up to date with payments, maintaining an active current plan, and meeting minimum stay requirements—typically two years for the first portability and one year for subsequent moves. Users must consult the ANS Guide to find compatible plans and submit requests to the destination operator, which has ten days to respond.

Regarding credit portability, individuals can move existing debts to different financial institutions to seek better terms. This process involves a new institution assuming the debt under a new contract. To ensure a genuine benefit, consumers are advised to compare the Total Effective Cost (CET)—which includes interest, taxes, and fees—rather than just the advertised interest rate, as extending the loan term to lower monthly payments may increase the total amount paid over time.
