Financial disclosure requirements in Illinois and Arizona divorce cases

Legal requirements for financial disclosure during divorce proceedings vary by state, but both Illinois and Arizona mandate the exchange of detailed financial information to ensure transparency in asset division and support calculations.

In Illinois, under 750 ILCS 5/501, parties seeking maintenance or child support must use a statewide financial affidavit supported by documentation such as tax returns, pay stubs, and bank statements. Courts have the authority to penalize parties who intentionally or recklessly file inaccurate or misleading affidavits with sanctions, including attorney’s fees and costs.

In Arizona, Rule 49 of the Arizona Rules of Family Law Procedure mandates the automatic exchange of financial documents, including debt statements and investment information. In contested cases where a spouse is uncooperative, legal tools such as depositions or subpoenas may be used. Failure to comply with these discovery requirements can result in monetary penalties or adverse court rulings.
