Financial implications of debt and bankruptcy during divorce

Divorce proceedings often involve the division of marital assets and debts, but legal settlements between spouses do not automatically release both parties from obligations to third-party creditors. Under laws such as New York’s equitable distribution or Florida’s statutes, a court may assign responsibility for a specific debt, such as a mortgage or credit card, to one spouse. However, if both individuals signed the original creditor agreement, the lender typically retains the right to pursue either party for payment regardless of the divorce decree.

To mitigate credit risks, legal experts suggest addressing debt through refinancing, selling assets, or closing accounts. In cases of significant unsecured debt, the timing of a bankruptcy filing—whether before, during, or after the divorce—can influence property division, eligibility for Chapter 7 or Chapter 13 bankruptcy, and the extent to which former spouses remain financially connected.
