Financial security measures following data leaks and device theft

In response to data breaches and device theft, financial authorities emphasize immediate protective actions to prevent unauthorized access to funds.

In Brazil, individuals whose personal data has been leaked are advised to use the Central Bank’s Registrato system to monitor for unrecognized loans, bank accounts, or Pix keys. Under the General Data Protection Law (LGPD), companies are required to notify affected individuals and national authorities of such incidents. Experts recommend changing passwords, enabling two-step verification, and filing police reports if fraud occurs. While compensation is possible, the Superior Court of Justice generally requires proof of actual damage for moral damages in cases of common data leaks.

In Portugal, the Banco de Portugal warns that losing or having a mobile phone stolen poses a significant risk to digital banking security. Users should immediately contact their financial institutions to cancel access credentials. Regarding liability, customers may be responsible for unauthorized payments up to 50 euros if the loss is not reported promptly, though this limit does not apply in cases of gross negligence or fraudulent intent. Once the bank is notified, the customer is generally no longer liable for subsequent unauthorized transactions.
