Finland plans to curb serial appellants delaying construction

The Finnish government is planning new measures to curb the activities of “serial appellants” who delay construction projects through repetitive legal challenges. Following a budget meeting on September 1, a working group comprising the Ministry of Justice, the Ministry of Finance, and the Ministry of the Environment has been established to find solutions.

Proposed legislative changes include introducing advance fees for specific administrative court cases that do not directly concern the appellant, as well as penalty fees for the misuse of the judicial system. Minister of Justice Leena Meri stated that while everyone must have the right to seek justice, the misuse of the system through “complaint manufacturing” must be prevented.

Additionally, the Ministry of Finance is preparing amendments to the Local Government Act to limit the right to appeal residential real estate transactions between individuals and municipalities to only the relevant parties. The Ministry of the Environment is also drafting a new land-use law to restrict appeal rights to direct stakeholders. Minister of Municipalities and Regions Anna-Kaisa Ikonen emphasized that investments and municipal development should not be held hostage by intentional legal delays.
