Fitzroy Beer Garden challenges Yarra City Council in Supreme Court
The Fitzroy Beer Garden is involved in a Supreme Court challenge against the Yarra City Council regarding its unauthorized use of two public laneways. Since the 1970s, the venue has used these lanes as part of its outdoor seating area, installing permanent structures such as concrete flooring, stairs, and a glass ceiling while blocking external access.
In June, the Yarra City Council voted to require the removal of all encroachments to restore the lanes for public use. While the building owners, X & G Pty Ltd, hold the property records, the council maintains authority because the lanes are listed on the public road register. Council officials stated the lanes are necessary for rear access to neighboring properties.
Public sentiment appears divided, though a recent consultation saw 62 out of 80 submissions favoring the reopening of the lanes. Venue owner Indy Weerakoon has stated that losing the use of the laneways would force the business to close.
