Florida condo owners face rising costs and legal disputes
Condominium owners in Florida are facing significant financial and legal challenges. Following the Surfside collapse, new safety reforms requiring stricter structural inspections and reserve-fund mandates have led to sharply rising homeowners association (HOA) fees and special assessments. These increased costs are disproportionately affecting seniors and residents on fixed incomes, leading to concerns that they may be forced out of their homes.
In a separate development crisis, the Mandarin Oriental Residences in Boca Raton, part of the nearly $1 billion Via Mizner project, has become embroiled in litigation and foreclosure. Construction has stalled nearly a decade after the original expected completion date, and the hotel portion of the development is in bankruptcy. At least 20 buyers are currently seeking seven-figure refunds for deposits paid on unfinished luxury units, with some even after winning arbitration rulings.
