Florida enacts law criminalizing fraudulent residential rental entry
Florida will implement HB 1293, a new law targeting fraudulent entry into residential dwellings, effective October 1, 2026. Signed by Governor Ron DeSantis, the legislation establishes the crime of fraudulent entry into a residential unit to address gaps in existing rental market regulations.
The law specifically criminalizes the knowing and intentional use of false identities, forged or fictitious documents—such as driver's licenses, bank statements, or pay stubs—and the impersonation of individuals listed on rental applications to secure housing.
Under the new statute, fraudulent entry is classified as a third-degree felony, punishable by up to five years in prison and fines of up to $5,000. Additionally, the law grants landlords the authority to terminate lease agreements when such fraudulent conduct is discovered.
