Florida Judge Orders Rewrite of Homestead Amendment Ballot Language
Circuit Court Judge David Frank ruled that the ballot title and summary for Florida's proposed Amendment 3 are misleading and contain political rhetoric. He ordered State Attorney General James Uthmeier to rewrite the language within ten days so voters receive a clear, accurate, and non‑advocacy description.
Amendment 3, drafted by Governor Ron DeSantis, would raise the homestead exemption from $50,000 to $150,000 in 2027 and to $250,000 in 2028, while also cutting the annual assessment cap for non‑homestead properties from 10% to 5%. The judge said the current wording functions as a sales pitch rather than an explanation of the amendment’s effects. The ruling is a victory for groups that sued over the ballot language, but it does not remove the measure from the November ballot; it merely requires a revised, neutral description before the deadline.
