Flushing man charged with manslaughter in fatal stroller collision

Elvin Rivera, 57, has been charged with second-degree manslaughter, vehicular manslaughter, and driving while impaired following a fatal collision in Flushing, Queens. The incident occurred on the morning of October 11, when Rivera allegedly failed to stop at a stop sign while driving a white Chevrolet Silverado pickup truck.

According to prosecutors, Rivera accelerated through the intersection and struck 1-year-old Justin Hu, who was being pushed in a stroller by his nanny. The child was transported to Jacobi Hospital in critical condition but was later pronounced dead. The nanny, 69, sustained injuries to her arm but remained in stable condition.

Authorities stated that Rivera failed a sobriety test at the scene, and subsequent drug tests revealed the presence of cocaine and THC in his system. Rivera, who has a pending DWI case, was arraigned in Queens Criminal Court and faces a potential prison sentence of five to 15 years if convicted of the top charge. He is scheduled to return to court on October 19.
