Foreign land ownership limits exceeded in Santa Fe's Garay Department

In the province of Santa Fe, Argentina, the application of National Law 26.737 regarding foreign ownership of rural land has reached a critical point in certain regions. While the province as a whole maintains a low foreign ownership rate of 1.71%—well below the national average of 4.97%—the law mandates that the 15% ownership cap be applied strictly on a per-department basis rather than provincially.

This departmental enforcement has created a bottleneck in the real estate market. The Garay Department has exceeded the legal limit, recording a foreign land concentration of 15.73%. Other departments, such as General López (3.50%), San Javier (3.10%), and 9 de Julio (2.47%), remain within the legal thresholds.

Legal requirements for transactions include obtaining a Prior Authorization Certificate from the National Registry of Rural Lands (RNTR). This regulatory rigor applies to all scales of operation, meaning even small plots of 30 hectares intended for intensive projects must undergo the same procedural scrutiny as large-scale holdings.
