France Constitutional Council validates agricultural emergency law

The French Constitutional Council has validated nearly all of the agricultural emergency law, including controversial provisions regarding water management and the temporary reintroduction of certain banned pesticides.

The Council ruled that allowing the use of acetamipride for hazelnut production and flupyradifurone for apples, cherries, and sugar beets serves the ‘general interest’ to protect crops from severe threats and prevent European competition distortions. While acknowledging these substances can impact biodiversity, pollinators, birds, soil, and water quality, the Council found the legal framework for these derogations sufficient. However, it issued two reservations regarding the specific geographic zones for these exceptions and the timeframe allowed for health authorities to issue rulings.

The decision follows challenges from left-wing groups, NGOs, and the Confédération paysanne, who argued the measures violated the Environmental Charter. Meanwhile, major agricultural unions such as the FNSEA, Jeunes Agriculteurs, and Coordination Rurale have sought easier access to water and pesticides, particularly as French agriculture faces unprecedented drought conditions.
