France: Legal and administrative hurdles for foreign residents

Foreign nationals in France are facing significant administrative challenges regarding residency permits and social benefits. Under the immigration law of January 26, 2024, undocumented workers in shortage occupations can apply for temporary residency until December 31, 2026. However, Algerian nationals are excluded from this specific pathway due to the 1968 Franco-Algerian agreement, which governs their legal status separately.

Administrative delays and silence from prefectures have led to legal disputes. In one case, an Algerian national in Hauts-de-Seine successfully used administrative courts to force the issuance of a residence permit after the prefecture failed to respond to a renewal request. Such administrative inertia can result in an implicit rejection of applications.

Furthermore, technical issues with the ANEF online platform have left many residents without valid documentation. While the platform confirms the submission of applications, these receipts do not prove legal residency. This has caused secondary consequences, such as the suspension of social benefits by the CAF (Caisse d'Allocations Familiales), as the agency requires more substantial proof of status than a simple submission confirmation.
