France: New legal protections and fiscal rules for local officials
New legal frameworks and administrative procedures are shaping the responsibilities and protections of local elected officials in France.
Regarding fiscal management, local and intercommunal decisions involving taxes, exemptions, or abatements require formal deliberations. To ensure application by January 1st, these deliberations should generally be adopted before October 1st of the preceding year. Proper drafting is essential to avoid legal disputes and public accounting refusals.
Additionally, Law No. 2025-1249 of December 22, 2025, establishes a specific status for local elected officials to better protect them from threats and legal risks. A key change in this reform is the redefinition of conflicts of interest; the law now focuses on interference between public and private interests, meaning the meeting of two exclusively public interests can no longer, on its own, constitute a conflict of interest.
