France Travail: Unemployment rights and sick leave rules

Unemployment benefits and employment termination rights in France are governed by specific rules regarding the involuntary loss of employment. Under France Travail regulations, the primary criterion for receiving Aide au Retour à l’Emploi (ARE) is whether the job loss was involuntary.

Various forms of termination, including dismissal for simple, serious, or gross misconduct, as well as economic redundancies and mutual agreements (rupture conventionnelle), generally preserve the right to unemployment benefits. However, voluntary resignations and job abandonment typically disqualify individuals from receiving benefits unless specific legitimate reasons are proven.

Regarding sick leave, when a job seeker declares a medical leave, unemployment benefit payments are automatically suspended and replaced by daily allowances from Assurance Maladie. This period does not reduce total unemployment rights; instead, the duration of the sick leave is deferred, effectively extending the period of eligibility. Failure to declare sick leave during monthly updates can result in overpayments that must be reimbursed and may trigger deregistration procedures for false declarations.
