France updates driving laws regarding nitrous oxide use

French authorities have introduced new legal measures to combat the misuse of nitrous oxide, commonly known as ‘laughing gas,’ by drivers. Under the new article L237-1 of the Highway Code, criminal courts can now penalize drivers for nitrous oxide consumption without requiring laboratory analysis. This change mirrors existing laws regarding manifest alcohol intoxication.

Previously, convictions required laboratory testing because nitrous oxide is difficult to detect and leaves the body quickly after inhalation. The substance, often used in culinary settings, is being diverted for recreational use, leading to serious neurological and cardiovascular risks. Effects include euphoria, dizziness, loss of coordination, and disorientation, all of which are incompatible with safe driving.
