France's Constitutional Council strikes down 2026 health insurance rate freeze
The French Constitutional Council has ruled that the 2026 rate freeze for complementary health insurance providers is unconstitutional. The measure, which was passed by Parliament in December 2025, was struck down following a priority question of constitutionality.
The Council determined that the freeze disproportionately infringes upon the freedom to conduct business and contractual freedom. It noted that the provisions prevented insurance organizations from setting rates sufficient to cover their economic activity costs, despite the legislative goal of consumer protection.
The freeze originated from an amendment by Socialist Party deputy Jérôme Guedj during debates on the Social Security budget project. The amendment aimed to prevent insurers from passing on a government-imposed tax to consumers. Prior to this ruling, insurers had already implemented planned increases, averaging 4.3% for individual contracts and 4.7% for collective contracts.
