France's Constitutional Council validates military programming law

The French Constitutional Council has validated the 2024-2030 military programming law, ruling that it balances national security interests with fundamental civil liberties and rights.

The decision addresses challenges raised by over 60 deputies from various political groups, including La France Insoumise and the Greens. The Council found that the law respects the Constitution, including protections for freedom of expression, property rights, privacy, and the Charter of the Environment.

A key component of the ruling is the validation of a new national security alert regime. This exceptional framework allows for the use of automated algorithmic processing, including internet addresses, to detect specific threats or interference under strict conditions. The Council determined that the framework is sufficiently precise and does not disproportionately infringe upon personal data protection or privacy rights.
