Francis Escudero implements two-strike rule for Duterte impeachment trial

Impeachment Court Presiding Officer Francis Escudero has implemented a two-strike system to enforce the sub judice rule during the impeachment trial of Vice President Sara Duterte. The new rules aim to protect the court’s impartiality and prevent trial by publicity.

Under the framework, a first violation of Rule 18 will result in a severe reprimand and a formal admonition on the record. A second violation will incur a fine of up to P30,000 per offense and may result in the offender being barred from speaking or examining witnesses on the floor. The rules apply to senator-judges, prosecutors, the respondent, and their legal counsels.

Escudero noted that while the court will “wipe the slate clean” regarding past comments made by parties involved, strict enforcement will begin immediately. Lawyers found in breach may also face disciplinary action from the Supreme Court or the Integrated Bar of the Philippines regarding their licenses to practice. The presiding officer emphasized that legal counsel must litigate within the court rather than through social media, interviews, or public surrogates.
