Italy implements new decree on juvenile criminal responsibility
Italy has enacted Decree-Law 190, which modifies the penal code regarding the criminal responsibility of minors. Under the new regulations, the capacity to understand and will (imputability) for minors between the ages of 14 and 18 is now presumed, unless proven otherwise. This shift moves away from the previous requirement of proving capacity on a case-by-case basis.
The decree also introduces new offenses to combat organized violence during public demonstrations and establishes economic sanctions for parents whose children engage in certain illicit behaviors. Additionally, the law expands the tools available to law enforcement to enhance public security.
Legal and political figures have commented on the changes. Deputy Andrea Pellicini noted that the update reflects modern societal changes and the increased awareness of youth due to digital tools. Meanwhile, Giuseppe di Giorgio, Chief Prosecutor at the Juvenile Court of Bologna, highlighted that while legislation is becoming stricter regarding property crimes and public order, it is essential to address the underlying fears and social integration issues driving youth violence.
