Freising district office revokes municipal council mandate

The Landratsamt Freising, acting as a municipal supervisory authority, has revoked the local council mandate of Peggy Spirk, an SPD candidate elected in March. The decision follows a determination that Spirk’s employment as a part-time pedagogical assistant at a municipal kindergarten constitutes an ‘Amtshindernis’ (official impediment).

Under Article 31 of the municipal code, employees of a municipality are excluded from serving as honorary council members unless their work is predominantly physical. While the local election committee initially approved her candidacy, the supervisory authority ruled that a violation of election law occurred. The SPD has filed a lawsuit with the administrative court to contest the decision. Herbert Hahner is set to be sworn in as the regular successor during the next council meeting.
