French Council of State rejects fuel price regulation appeal in Corsica

The French Council of State has rejected a legal challenge brought by the collective ‘Agissons contre la cherté des carburants en Corse’ regarding high fuel prices on the island. The group, led by Frédéric Poletti, sought to overturn the government's implicit refusal to implement fuel price regulations.

The court ruled that while Article L. 410-2 of the Commercial Code allows for price regulation in sectors with limited competition or supply difficulties, this remains a discretionary power rather than a legal obligation for the government. The Council of State determined that the government's decision not to act is not subject to review by the abuse of power judge.

In response, the collective expressed disappointment, stating they have ‘lost this legal battle.’ However, they noted that the ruling does not validate current fuel prices or confirm that competition is functioning effectively in Corsica. The group criticized the government for prioritizing oil company dividends over consumer protection.
