French Court dismisses complaint against Gérald Darmanin

The Court of Justice of the Republic (CJR) has dismissed a complaint filed against French Minister Gérald Darmanin for ‘failure to assist a person in danger’. The complaint was brought by the mother of a young girl, Rosa, in connection with the Lyhanna affair.

The Lyhanna case involves the death of an eleven-year-old girl found dead in Gers on June 4. The primary suspect, Jérôme Barella, had previously been the subject of a complaint by Rosa’s mother, who accused him of raping her daughter approximately fifty times. The mother’s complaint against Darmanin alleged that the Minister failed to ensure the judicial system effectively processed complaints regarding sexual violence against minors, despite known systemic issues.

The CJR’s requests commission ruled that the offenses of ‘endangering the life of others’ and ‘failure to assist a person in danger’ were not established. The commission noted that the complaint did not reference any specific legal text imposing such an obligation on the Minister. This decision is final and cannot be appealed.
