French court suspends expulsion of Moroccan national

The Administrative Tribunal of Poitiers has ordered the Prefecture of Deux-Sèvres to re-examine the residency status of a Moroccan national facing expulsion from France. The decision provides a provisional suspension of his obligation to leave the territory.

The individual, who has resided in France since at least 2018, was previously granted a residence permit under the 'private and family life' category following the birth of his son in 2022. However, his legal status changed after the Niort Criminal Court sentenced him to a one-year suspended prison term for domestic violence committed between 2019 and 2025. The court also imposed a three-year ban on contacting the victim or approaching her home.

Following the conviction, the Prefect of Deux-Sèvres refused to renew his residence permit, citing a threat to public order and issuing an obligation to leave French territory (OQTF). The man contested this decision, arguing that his relationship with his French son must be considered. The court's intervention follows evidence of his financial support for the child and his maintained visitation rights, despite the mother having sole custody.
