French courts rule on major highway construction disputes
The Toulouse Administrative Court of Appeal has rejected appeals against the regularization of construction sites for the A69 motorway, which connects Toulouse and Castres. The ruling validates the prefectural orders that regularized work performed by the concessionaire beyond initially authorized boundaries. While the Tarn prefecture views the decision as a confirmation of state procedures, opposing associations argue that procedural irregularities remain and intend to continue legal challenges on the merits. The A69 is scheduled to open on November 6.
In a separate matter, a collective of associations, farmers, and residents has petitioned the Lyon Administrative Court of Appeal to suspend construction of the A412 motorway in Haute-Savoie. Opponents, led by France Nature Environnement, argue the project is illegal under environmental law and contradicts climate urgency. They advocate for increased rail and bus services instead of the 16.5-kilometer stretch. Protesters have engaged in sit-ins and tree occupations to slow forest clearing, resulting in numerous fines and police detentions. The state and the concessionaire, Amedea (an Eiffage subsidiary), maintain the highway is necessary to ease commuter traffic between Thonon-les-Bains and Geneva.
