French legal rulings on property owner liability for intruder injuries

Legal precedents in France clarify the liability of property owners when intruders or illegal occupants suffer injuries on their premises. Under French law, a homeowner is not automatically responsible for injuries sustained by an intruder who climbs onto a balcony of their own volition.

However, liability may shift if the injury is caused by a defect in the property. For instance, if a railing or guardrail is poorly maintained or structurally unsound, the owner or the co-ownership association may be held responsible. A ruling by the Cour de Cassation highlighted this principle, where a landlord was held liable for an occupant's fall from a kitchen window after a poorly maintained guardrail failed, even though the individual was occupying the premises illegally after their lease had ended.

Regarding property damage, such as broken windows or railings caused by intruders, the costs are generally the responsibility of the perpetrator, though actual reimbursement often depends on insurance coverage and the specific legal status of the property.
