Frisby España begins operations in Madrid following trademark ruling

Frisby España will begin commercial operations in Madrid on Monday, August 17, initially offering services through the Uber Eats platform. The launch follows a legal dispute with the Colombian fried chicken brand, Frisby S.A. BIC, regarding trademark rights in Spanish territory.

The Spanish Patent and Trademark Office (OEPM) ruled in favor of Frisby España by declaring the expiration of three trademark registrations held by the Colombian company since 2001. The OEPM determined that the Colombian brand’s registrations were invalid due to a lack of effective commercial use in Spain, noting that social media presence and app downloads within the Colombian community were insufficient evidence of local activity.

Frisby España, which describes itself as an independent European project, plans to expand its footprint by opening three additional locations before the end of the year, including one physical storefront. The company also intends to reach Barcelona by September 2026. Despite the recent rulings, the company noted that several judicial proceedings remain ongoing in the courts.
