FTC sues Hims & Hers over health data sharing and deceptive subscription practices
The U.S. Federal Trade Commission, joined by the attorneys general of California and Utah, filed a lawsuit against San Francisco‑based telehealth company Hims & Hers Health, Inc. The complaint alleges that the firm disclosed patients' sensitive health information to advertising platforms, including Meta Platforms and Snap Inc., without proper consent. It also accuses Hims & Hers of false advertising and steering consumers into recurring prescription subscriptions through misleading language such as “Pay $0 today” while burying key billing details in small print.
The FTC says customers were often unable to cancel easily, having to navigate a multi‑step process before a one‑click option was introduced in some states. “The FTC’s complaint lays out a troubling scenario—consumers unknowingly locked into recurring subscriptions and the disclosure to third parties of consumers’ most private health information without their consent,” said Christopher Mufarrige, director of the FTC’s Bureau of Consumer Protection.
