FTC Sues Hims & Hers Over Health Data Sharing and Billing Practices

The U.S. Federal Trade Commission filed a lawsuit against Hims & Hers Health, Inc., joined by Los Angeles County, Utah and California, accusing the telehealth provider of sharing users' sensitive health information with online advertisers Meta Platforms and Snap. The complaint says the company used tracking technologies and customer lists to transmit health data, violating its privacy promises.

Regulators also allege deceptive billing practices: customers are charged for prescriptions before seeing a healthcare provider, many are enrolled in recurring subscription plans without clear consent, and cancellations are made difficult through hidden buttons and short notice windows. Hims & Hers denied the allegations, calling the suit “baseless” and saying it will defend itself vigorously. The announcement sent the company's shares down 10‑13% in trading.

The case highlights growing regulatory scrutiny of digital‑health business models that combine consumer‑technology growth tactics with medical services.
