Romania Parliament moves to resolve local councilor job incompatibility crisis
A legislative change to the Romanian Administrative Code, specifically Law no. 165/2026, has caused significant disruption among local and county councilors. The amendment to Article 550 extends incompatibility rules—previously applying only to public officials—to contractual staff within the public sector. This requires councilors who also hold public sector jobs to choose between their elected mandate and their employment.
To resolve the incompatibility without resignation, the law allows for the suspension of individual employment contracts. Following the controversy, the Romanian Parliament moved to address the issue. Parliamentary committees voted to eliminate the specific provision that created the incompatibility, effectively preventing thousands of elected officials from being forced to choose between their mandates and their public sector jobs.
