Galician Court mandates salary bonus for Ourense hospital technician

The High Court of Justice of Galicia (TSXG) has ruled that an electromedicine maintenance technician at the Complexo Hospitalario Universitario de Ourense (CHUO) is entitled to a 35% salary supplement. The bonus is designated for hardship, toxicity, and danger associated with the worker's duties.

The court ordered the maintenance company to pay 5,311.45 euros in back pay covering the period from November 2023 to September 2024. This decision upholds a previous ruling from the Social Court number 2 of Ourense, dismissing an appeal by the company which argued that the alleged risks were not inherent to the position.

The technician's responsibilities include changing operating room filters, cleaning cooling towers, handling chemicals, and working in nuclear medicine areas and isolation rooms. The court noted exposure to risks such as ionizing radiation, infectious diseases, bodily fluids, and corrosive substances. The ruling is based on the Ourense siderometallurgical collective agreement, which grants this supplement to maintenance personnel working in hospitals and prisons.
