Galicia's Supreme Court rules IBI tax for Álvaro Cunqueiro Hospital falls to concessionaire

The Tribunal Superior de Xustiza de Galicia (TSXG) ruled that the payment of the municipal property tax (IBI) for the Álvaro Cunqueiro Hospital in Vigo must be made by the concessionaire, not by the Xunta de Galicia. The decision overturns a 2019 administrative court judgment that had ordered the regional government to reimburse nearly one million euros to the concessionaire. The TSXG cited the contractual documentation, stating it did not create an implicit obligation for the administration to cover the tax if the exemption were removed. The ruling also reaffirms a May 2022 decision that had been annulled by the Spanish Supreme Court because of concerns about the impartiality of judge Luis Villares. The new judgment confirms that the health service (Sergas) must guarantee fiscal indemnity to the concessionaire under the existing contract terms.
